Please read the following important Terms of Service Agreement (the "Agreement") before accessing or using any of the various services (the "Services") made available to you (the "Member") by/through https://so-related.com ("INRU-ol"). By completing the registration process for INRU-OL website, you represent that you are of age to use the website, and can and will be legally bound by this Agreement. Only users who are 13 years of age or older may register for SO-INRU-OL. MODIFICATIONS INRU-OL reserves the right to modify or amend this Agreement at any time, for any reason, or for no reason at all, at INRU-OL'S sole discretion. The most recent version of this Agreement will be posted on the INRU-OL website. Although INRU-OL will provide notice of material changes to this Agreement on the INRU-OL website, as a Member it is your sole responsibility to keep yourself informed of any such modifications or amendments. Should Member object to any terms and conditions of the Agreement or any subsequent modifications thereto or become dissatisfied with INRU-OL in any way, Member's only recourse is to immediately: (a) discontinue use of INRU-OL; (b) terminate INRU-OL registration; and (c) notify INRU-OL of termination. DESCRIPTION OF SERVICES As a Member, you will be provided with a variety of services, as described on the INRU-OL website (the "Services"). Members may also utilize certain additional services offered from time to time such as shopping and e-commerce offerings and various informational services. INRU-OL reserves the right to enhance, modify, or discontinue the Services, in whole or in part, at any time, for any reason, or for no reason at all, at INRU-OL'S sole discretion, with or without notice to Members, and with no obligation to Members. MEMBER CONDUCT Use of the Services by you, as Member, is subject to all applicable local, state, national and international laws and regulations. INRU-OL reserves the right, but does not assume any obligation, to monitor the Services to enforce this Agreement, nor does INRU-OL guarantee that any monitoring it does perform will be to the Member's satisfaction. Upon learning of any violation of this Agreement, INRU-OL, at its sole discretion, may terminate your access to and use of the Services, require you to remedy such violation, and/or take any other actions that INRU-OL deems appropriate to enforce its rights and pursue all available remedies. Without limitation,INRU-OL reserves the right to terminate your access to and use of the Services if, in our view, your conduct fails to meet any of the following guidelines: Members shall not engage in any activity that constitutes harassment, including, but not limited to, excessive repetition when listing a person as a referral. Members shall not list the email addresses of people unknown to them. Members shall not list as referrals any email addresses that are fake, fictitious, or made up. Members shall not list as referrals any email addresses which are owned by or belong to that member. Members shall not attempt to interfere with any other person's use of the Services. Members shall not misrepresent their identity or impersonate any person. Members shall not hold themselves out as sponsored by, endorsed by, or affiliated with the INRU-OL website. Members shall not use any portion of the INRU-OL website or the Services for uploading, posting, emailing, transmitting or otherwise making available junk mail, commercial advertisements, or any other form of commercial solicitation. Members shall not use any portion of the INRU-OL website or the Services for uploading, posting, emailing, transmitting or otherwise making available content, including user names and friend list names, that is harmful, threatening, abusive, vulgar, obscene, profane, defamatory, libelous, hateful, or racially, ethnically or otherwise objectionable. Members shall not upload photos, graphics or other content that contain or promote illegal substances or activities, including, but not limited to, underage drinking or smoking, substance abuse, weapon use, or gang affiliation. Members shall not post content that displays pornographic or sexually explicit material of any kind. Members shall not provide material that exploits people under the age of 18 in a sexual or violent manner, or Members shall not provide instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses. Members shall not attempt to gain unauthorized access to INRU-OL database or other computer systems. Members shall not attempt to modify, translate, adapt, edit, de-compile, disassemble, or reverse engineer any software programs used by INRU-OL in connection with the INRU-OL website or the Services. Members shall not engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Services or the INRU-OL website. Members shall not use any portion of the INRU-OL website or the Services for any unlawful purpose. All judgments concerning the applicability of these guidelines shall be at the sole and exclusive discretion of INRU-OL. INRU-OL will remove the offending material and alert the member against repeating the offense. If another direct violation of our Terms of Agreement is committed, a member's account will be fully terminated. A member is not necessarily offered a warning. An account may be terminated at any time, without notice, depending on the severity of the offense.

TEXAS LAW ON ONLINE HARASSMENT

Effective September 1, 2009, a new Texas law makes it a crime to engage in various activities on commercial social networking sites or by e-mail, instant messaging, etc. Note that depending on the activities involved, the crime can be either a class A misdemeanor or 3rd degree felony.

AN ACT

Relating to the creation of the offense of online harassment.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 33, Penal Code, is amended by adding Section 33.07 to read as follows: Sec. 33.07. ONLINE HARASSMENT. (a) A person commits an offense if the person uses the name or persona of another person to create a web page on or to post one or more messages on a commercial social networking site: (1) Without obtaining the other person’s consent; and (2) with the intent to harm, defraud, intimidate, or threaten any person. (b) A person commits an offense if the person sends an electronic mail, instant message, text message, or similar communication that references a name, domain address, phone number, or other item of identifying information belonging to any person: (1) without obtaining the other person’s consent; (2) With the intent to cause a recipient of the communication to reasonably believe that the other person authorized or transmitted the communication; and (3) With the intent to harm or defraud any person. (c) An offense under Subsection (a) is a felony of the third degree. An offense under Subsection (b) is a Class A misdemeanor, except that the offense is a felony of the third degree if the actor commits the offense with the intent to solicit a response by emergency personnel. (d) If conduct that constitutes an offense under this section also constitutes an offense under any other law, the actor may be prosecuted under this section, the other law, or both. (e) It is a defense to prosecution under this section that the actor is any of the following entities or that the actor’s conduct consisted solely of action taken as an employee of any of the following entities: (1) A commercial social networking site ; (2) An Internet service provider; (3) An interactive computer service, as defined by 47 U.S.C. Section 230; (4) A telecommunications provider, as defined by Section 51.002, Utilities Code; or (5) A video service provider or cable service provider, as defined by Section 66.002, Utilities Code. (f) In this section: (1) ” Commercial social networking site ” means any business, organization, or other similar entity operating a website that permits persons to become registered users for the purpose of establishing personal relationships with other users through direct or real-time communication with other users or the creation of web pages or profiles available to the public or to other users.
